QUESTION:
I was arrested on Wednesday morning I was held until I bailed late Friday night
ANSWER:
You have a right to be brought to court within two court days from your arrest. By not bringing you to court on Friday, the sheriff’s department violated your rights to a speedy trial (assuming your were not in sick call or something of that nature.) Unfortunately, the right to speedy arraignment is often called a right without a remedy. The violation will not lead to your case being dismissed. I’ve been fighting this battle in SLO somewhat frequently. Contact me if you’d like to be added to a list I’m compiling to file a complaint.
