QUESTION:
Have a court appearance coming up and my public Defender wants me to go to an Inpatient rehabilitation program. Can I be arrested while in there? Is that a reason to be not be present for court?
ANSWER:
If it’s a misdemeanor case, you should be able to make arrangements for your attorney to appear without you. Furthermore, most judges want to see people remain in a Residential Treatment Program … but RTPs aren’t quite the Ecuadorian Embassy … a person can be arrested there.
