QUESTION:
So I was visiting a friend when Sheriff showed up because of his ex-girlfriend who came to get her belongings well they asked me if I was staying or leaving and I said leaving so they told me they had to search my stuff because my friend had probation but it is pretty messed up because as he helped me with my bags he hid stuff in one of my bags and I got charged for it and because it was in my stuff but why did they search me if he didn’t get charged for his own stuff
ANSWER:
In theory, you could report your friend to the Sheriff’s Department for the unlawful possession of drug paraphernalia in violation of California Health and Safety Code section 11364. The Sheriff’s Department could then forward a report to the DA for potential prosecution. I suggest you speak with the attorney defending you before making statements to law enforcement about an open case.
